Prop 65 – What You Should Know

In 1986 California voters passed the Safe Drinking Water and Toxic Enforcement Act, often referred to as Proposition 65. This legislation requires businesses to provide a “clear and reasonable warning” before exposing anyone to a listed chemical that California’s Office of Environmental Health Hazard Assessment (OEHHA) has determined to be a carcinogen or a reproductive toxicant and applies to all companies that operate in California, sell products in California, or manufacture products that may be sold in California.

In August 2016 the OEHHA adopted new regulations that require tailored warnings that identify the chemical(s) contained in the product in order to gain safe harbor protection. These changes address the labeling on product packaging in addition to adding a new requirement that warnings be included on website landing pages and catalog pages that are used to sell products to consumers in California. The new regulations became effective on August 30, 2018 and apply to all applicable products manufactured after that date.

Brasstech has updated product labels in order to comply with the new safe harbor requirements.

It is important to note that if a product contains a Prop 65 listed chemical it does not mean that the product is not safe nor does it mean that it will cause cancer, birth defects or other reproductive harm.
